    Bank charges could repay 8%

    Just picked this up from another consumer site. This is the work of others and I claim no credit for it but just bringing it to the attention of the widest audience possible.

    There is a possibility that, once the HOL rule on bank charges then anyone thinking of claiming will lose the right to pursue through the courts.

    If you have a claim but have not put in a MCOL claim, or similar, would only get the charge difference repaid. If you work out your full claim - refund of all charges, any account interest implications and submit to the county court, then it will be stayed until the HOL ruling but the court process allows for an addition of 8% interest PA to be added to the claim.

    The advice is get your charge details worked out and submit a claim through the county court. It will be stayed, of course, but the claim will include the 8% interest. If you do this, you may not be successful, depending upon the ruling but it is highly unlikely that you would be able to apply to the court retrospectively so would not get the benefit following the ruling
