    If the agency agreed to a settlement (over a period) subject to contract, then yes you can claim this overpayment money back. In the first instance I suggest you write to them (by recorded delivery of course) and see what their position is. You can claim this money (plus reasonable expenses) via the small claims Court if they become difficult.

    Getting back overpayments from collection agency

    Hi

    A few years back in 2006 i left DHL as a driver to become self-employed. After i left, DHL sent me a letter explaining that i had taken too much holiday for the yearly period and had to pay back £395.37 for day's taken off.

    After complaining that they told me "after" i had left the company and didn't give me the chance to see out the year they gave the dept to a dept collection agency.

    I talked with the agency to say that i couldn't afford the lump sum and would they accept a monthly payment of £30 a month to which thay agreed. They sent me a letter to show the bank explaining how much was to be charged and how many payments to be made from my account.

    I hadn't been keeping up to date with that account and have just realized that i have made too many payments. By around £500. I know i should have kept an eye on it and blame myself. I thought the letter explaining the payments to the bank would be stopped at the required amount but as i've since been told i should have set up a direct debit. The collection agency have not been in touch to tell me anything at all.

    Would i be able to claim the money back from the collection agency?
