    virgin media contract ?

    Hi all you Virgin media buffs,

    Im helping out my daughter with her Virgin media problems and need some basic info.

    She only has the basic broadband package. She's been having the usual late payment/service cutoff problems with them.

    Whenever she phones them up to discuss the matter they always quote 'your contract says this' or 'your contract says that' etc. This may seem a silly question but, when she requested the service over the phone, she never got a physical contract to sign. Does the request for service constitute a contract or do they actually require a signed contract as per HP/loans etc ? What are the legalities?

    Any help please.

    Yes. An agreement over the phone constitutes a legally binding contract. However, she cannot be considered to have agreed to anything unusual or important that wasn't mentioned on the phone. If, for example, it wasn't mentioned that the contract lasts 2 years then that part of the contract can't be enforced. Similarly if that part of the contract was explained later without her getting the chance to say "yes" or "no" then it wont be enforceable.
