    Verbal Contracts are indeed binding in Scotland. However, the tricky bit's proving them. Only Call Centres can really get away with using verbal contracts all the time as they record all calls. As it is, unless you have a witness to this verbal contract, im afraid you'll just have to write this one down to the shop being rubbish.

    If you did have a witness, you'd most likely still have to take it to court.

    A verbal agreement is usually not worth the paper that it's written on.

    The last comment is true, but even then verbal contracts are to my knowledge only binding in Scotland.

    Hi -- Although it's probably not what you want to hear, unless you can prove this verbal agreement took place.... then you would have no chance of it forming a legally binding contract....Sorry. !

    Hi

    In early January I went to a jeweller who had their sale on and saw a ring that I wanted to buy. The ring was half price but they did not have my size in that branch. They said that they would get a ring transferred from another branch and I asked whether I would need to leave a deposit for the ring or pay for it in full to ensure that I paid the sale price. As it was the start of January they said that the ring would be in with about a week and there was no requirement for a deposit or to pay in full. However after two weeks the ring had not been sent (it appears that they forgot or something??) - they put a fresh request for the transferral and again I asked whether I would need to put a deposit to ensure that the ring could be purchased at the sale price (as I was then aware that the sale was coming to an end in about a week and made this point to the sales advisor). Again I was assured that they would honour the sale price and there was no need to worry. The ring took another two weeks by which time the sale was finished - I have just been to pick up the ring and been told that they will not honour the sale price - I am distraught because it was an engagement ring and as a result of the sale was half the original price (which is significant). Although my details are in their order book (dates / sale price of ring etc) they say that their staff 'conveniently' cant remember making these assurances - this was not just one staff member but two, on two separate occasions that made this statement. They have said that as a good will gesture they will give me 25% off the ring but not the original 50%. Does the above constitute a verbal contract - do I have any rights regarding the purchase of the ring that the sale price that was agreed verbally?
