water leak from shared water pipe under neighbours house who has their own supply

    scenario:

4 houses in a terrace with a shared water mains supplying 3 out of the 4 and the odd one having their own seperate supply off the mains from the street.

Leak under the odd one out house who has own supply and not on the shared system the leak coming from the shared pipe which they are not connected to (confirmed by water board when they come to do assesment etc)

We are covered by water company policy who are going to cap off a stop valve and instate seperate supply feed for the 3 houses on the shared water system. The leak has caused internal damage ie damp etc in the odd one out house they have gone to their buildings and contents insurer who are consequently sending an assesor down and the neighbours have asked for the insurance details of the 3 homes on the shared system so that their insurance company can claim against us for the internal damage.

My question is must we supply this as firstly we were not aware they were on a seperate supply to the rest of us and their damp problem has not just happened over night but a period of time due to the leak under their property which we were not aware of until the water pressure dropped which triggered this whole sequence of events in the first place.

I am happy to use my water insurance policy for the 3 of us on the shared supply but must I supply my insurance details to my neighbour for his internal damage which we were not aware of but he obviously new about.

To be honest, you would be best after informing your company let them just supply all the details requested and let the insurers or claimants sort all the liability out between themselves, your insurers won't rush to pay out a settlement if they believe they are not liable and would probably seek a Surveyors opinion backed up with the necessary legal advice.

Life is too short to become involved in what could turn into a "fiasco", at the end of the day you pay your money so they can sort these problems out between themselves....I would just co-operate provide the information and just sit back and let them decide the final outcome. !

    UPDATE

As my neighbours insurers have said it is not neglience on anyones part as we nor them could see the leak under their house they are going to claim for the damage to their kitchen from the own household insurance policy.

During the excavation to try and source the leak homeservce contractors had to dig up part of my neighbours drive they have reinstated this but with a different colour of tarmac to the original he has now complained and said to me that homeserve have agreed to reinstated the whole drive, this whole issue is being claimed from my homeserve policy. I said to my neighbour I am was happy to use the policy to resolve the whole situation but if by you having your whole drive redone means it will take the covered amount currently £3000.00 for works plus £500 reinstateed costs over I do not have any money to pay towards it.

My questions is I want the leak dealt with as it is coming up onto my drive although the source is under my neighbours house, must I also have the other 2 homes repaired on my policy?

I am sure my neighbour knew there was a problem as the damage he is reporting could not have started immediately after we reported the water coming up on our drive but of course we are unable to prove it. Homeserve have told me that they received a complaint from regarding the drive but in their terms and conditions it does state it the reinstatement may not be an exact match.

If anyone has any experience with this company please please can you assist, what started trying to be neighbourly has turned into a complete nightmare and I am quite happy to now say forget it and leave it as it is.
