    do we need to find all the owners or is it just the one above the flat. Most of them are rented.

    I would ask your neighbour then and see if you can insure the property between you, the policy will then go to the freeholder to ensure that there is adequate cover, they also have to agree.

    Thanks Ian,

    Well,in our case the freeholder is not oblidged to ensure the property. We talked to one of the owners next door and they have insurance separately.

    What can we do?

    A flying freehold is when a part of the property overhangs a piece of land not on the deeds so it is irrelevant. The options are....... leasehold where the freeholder has the buildings insurance and the leaseholders get their own contents insurance. Or common freehold where the flat owners share and own the freehold and provide their buildings insurance between themselves.

    Is it an option to find the owner of the above flat (he is renting it at the moment) and use the same insurer? How can we go around this problem and make it less risky?

    Hello again,

    what do you mean by ' flying freehold'?

    If the freeholder is normally providing the building insurance, why there are people and insance companies offering flat insurance as well? The freeholder is not charging any maintenance fees and the ground rent is very very low therefore the freeholder is not involved. Is it something to be concerned about?

    This is strange.....normally a single dwelling that is mortgageable will offer separate leases. This means that the freeholder of the whole building provides the buildings insurance and the leaseholders provide their own contents cover.

    home insurance query

    Hello,

    Me and my partner are about to buy our first property. It is the first floor flat in a terraced house. I checked a few of the options we have via the web site which is very useful.

    However, our solicitor is concerned as the owners are insuring the flats separately. Not sure if this is an issue or not as it seems that many flats in this type of houses are insured as per the owner's request.

    Please advise if there is anything we need to consider.
