    land of leather

    have had a defective suite ,and have arranged a so called figure with my local store .. having been told on bank holiday monday by the branch manager it would be sorted within the next coming week ,its now been over five weeks and still no check or sign of collection date .. have called the store monday just gone 22.09.08 then thursday 25.09.08 .. and the excuses is they have had new computer system installed .. i was wondering if someone could advise me on the next move as i`m going away in ten days and wanted it sorted before i go .. my son works in a customer service role and feels the branch and land of leather are fobbing me off , can anyone help me

    Jan -- If they are not taking you seriously, then tell them that you wish to reject the faulty goods they have supplied as unfit for it's purpose and not of satisfactory quality for the purpose you have purchased it under the sale of goods act.

    This entitles you to an immediate full refund or a replacement or a repair whichever you so choose, you may find that they will stop trying to fob you off and make a proper arrangement that is convenient to yourself after you inform them you wish to exercise your legal right to a refund in full. !

    thank you for your help & advise, i will be contacting the store on monday when the manager returns from his weeks hoilday. i will update you on my progress.

    just had a thought before getting on to store Monday, my fault is that the colour has faded on my suite in certain areas, it looks like the dye has come out.would the answer still apply being i have had the suite 18 months, they are not giving me a full refund because of wear & tear. which i know i have to except, but i have been trying to sort this problem since early July. after phoning the store & told it has to be put in writing, which i did but got no response ,so then after three weeks i then wrote another letter, and the manager then got in touch with me. which i then arranged on August bank holiday Monday to go & either pick another suite or my money back on what we agreed.but after finding this sight i really do not want another suite from land of leather, only it seems to be a pretty common problem. all i want to know the reply you sent me on my original will it still apply.

    Hi -- What was the date of purchase. ? From your original post I got the impression that you bought this last bank holiday ...5 weeks ago !

    If you have in fact had it 18 months then the right to a full refund will not apply, but a partial refund minus an amount for wear and tear is reasonable, or a replacement or repair is still within your rights.

    actual purchase was August 06, but then i had to wait 14wks for delivery, this i pointed out to manager of the store, so i only actually had it delivered to my home November 2006.

    can you tell me what rights do i still have from my last post i sent , all i want is what was agreed with the manager to pick up my suite & my refund which he has been saying since bank holiday monday they will pick it up. i have been ringing the store once or twice a week ever since, and get the same answer it will be next week. i really want to get in touch with the store asp, as i said in of my previous messages this has been going on since early July

    I have already told you in the previous post above. !

    You could also in addition make the manager take proper notice of your complaint by complaining to the head office, or take the matter to your local CAB to apply pressure.

    At last i have got a response from the store after my call yesterday, i told them i have taken legal advice & wish to exercise my legal rights under the sale of goods act. i asked for them to pick up my suite & to have my cheque of a partial refund as agreed with myself & the manger, the latest of Monday of next week, being after that date i will be away. And hey presto they are sending the paper work out today to head office. i did say that i wanted an answer asap & got my call mid morning, i might add this is the first time they have rang back.

    hey guess what, no call from LOL so rang the store today asking for a date of my cheque & pick up of the sofa, the lady i spoke to said she will email head office which i did ask for a response today, still have had no call. but she did say it looks like i will not get my check until i am back from holiday, time is running out being i fly out on wednesday. i cannot under stand what the hold up is.i am an oap and finding this very stressful. any suggestions as to what i can do next. i do think it has gone on a bit being i have been waiting since august bank holiday for the pick up of my sofa & cheque.

    Sorry no other suggestions than already made, except to apply more pressure. !

    Visit your local CAB they can do this in a more menacing way for you, they are experienced at this and will get more results with a letter on headed notepaper.

    At last i now have a collection date for my suite which is tomorrow, and also i am finally getting my cheque. its pays to keep kicking up a fuss my son got in touch with the regional manager .... and it was sorted within three days. thanks for your kind advice Jan......
