    Cease Fees are illegal - if you have done the minimum contract period - an ISP is NOT allowed to fine you for leaving them

    Bah, there is something in the T&C after all:

    7.2 You agree to pay Us a Cease Charge fee where Our Carrier levies such a fee against Us.

    I missed that. Still annoyed though...

    Hello,

    I recently ended my service with Eclipse Internet. I have been a live-in tenant for the last year and a bit and I paid for and used the broadband connection myself. (I paid extra for a monthly contract because I wasn't sure how long I'd be there but the connection was active for more than a year in the end anyway). I've since moved and cancelled the service as my landlady didn't want to maintain it.

    Anyway, after the ADSL was disconnected Eclipse took two lots of money out of my account, one for the service up to the disconnect date and another "one off fee" for £5.76. I queried Eclipse and (to their credit) they replied quickly stating that the £5.76 was 'Cease Fee' which BT charge them and they have passed on to me. Apparently this is 'standard', which could just mean that they charge everyone and most people just pay up.

    My question is does anyone know if there is a legal basis for taking this money out of my account? As far as I see things my broadband agreement was with Eclipse not with BT. And Eclipse have never mentioned this fee before, I certainly can't find it in the terms and conditions.

    As I see it Eclipse's relationship with BT is their business and if BT see fit to charge extra fees, Eclipse should either absorb the costs or make a passed on fee clear in their terms and conditions.

    So have Eclipse taken money from me unlawfully or is their a legal angle I'm missing that allows them to take ill-defined fees from my account?
