DFS credit agreement , any advice?

    thanks conmankiller, it was this morning that they told me i would still have to pay for the suit if i ended the finance. so have not been back in touch with them or phoned the finance. i was waiting to see if anyone can gove advice on this. do you suggest ui just phone finance now and end the agreement then phone them to say basiclly what u have replied? i am just woried anything bad may come out of it? they said that all suites were made to order thats why i have still to pay for it.

    Hi Nichola ---- Well, seeing as the whole deal depended on the finance agreement going ahead and now the finance has legally been terminated, what do the "Muppets" expect you to do.?

    Legally you have ended the sale agreement because it was always dependent on the finance going ahead right from the start, had you been paying in cash and placed a deposit they might have had some lever against you, but even then after such a short time they would not be able to prove they incurred any extra costs.

    Phone them and explain that the whole deal was dependent on a finance agreement which has now been legally terminated under the consumer credit act, tell them that if they still want to deliver the suite, that providing it is free and there is no charge whatsoever, that you will of course accept it as a gift. !!!

    Providing you have rung to cancel the finance and back it up in writing then .......I think it will end at that. !!!

    I have just came off the phone to dfs and they said that the finance has went through and that i can call them and cancel the finance but the suite has been orederd so i still have to pay for it? can anyone let me know what i should do

    thanks for everyones time of advice. just looked a the agreemetn the finance company is Hitachi Capital. i tried to phone last night to dfs but the store was closed, does anyone think i should send an email to the store as it has given me the email address? and also to contact hitachi this way, and also by phone later at 9 when it opens? and phone the finance after i have spoken to dfs?

    thanks for putting me right conman. i somehow assumed those rules only applied to cold calling, however i bow to your knowledge. so, as Nichola says dfs are going to phone the finance people tomorrow, Monday. she still has time to cancel agreement i would suggest she gets down to the store before they open quoting the consumer credit act backed up with a letter of cancellation. Nichola do get back to us with the outcome.

    Hi --- If you sign a credit agreement on the traders licenced premises the Consumer Credit Act does allow you to withdraw from the agreement in the very short timeframe before the creditor actually signs it.

    The time period is very short and once the creditor has signed the agreement it becomes 'executed' and you cannot then withdraw. To withdraw from a prospective agreement you must contact the finance company or their broker and inform them of your intention to withdraw. This can be done by telephone but always back it up with a letter confirming the withdrawal.

    You must ring and cancel the agreement first thing in the morning witnessed if possible then back it up with a hand delivered cancellation, get a signature for your future proof should it be brought into question, if you are unable send recorded delivery first class.

    as "you" approached dfs and no doubt signed a contract you have little come back, you could discuss it with dfs explain you want to do business with them but not on present terms.

    DFS credit agreement , any advice?

    hi

    i am looking for some advice, i went and tried to take out finance on a sofa from dfs, but now feel that i was talked into it, after i came home and sat down and thought about it its not what i want, i feel i have jumped into it. . i have the credit agreement here and the man is going to phone the finance people tomorow to see about the finance. is there anyway i can cancel the agreement? i have not paid any deposit as it was on a 2yr agreement with 1st year payment free. any advice would be appreciated, thankyou
