Hi, im after some advice if anyone has any to offer,
well heres the story,
i went to Concept car credit in Dec 06 with the intent of having a look, for a newer car, i found one that i liked and could afford the repayments on, so went ahead with the sale,
anyway i gave my old car for a deposit and drove away the same day, the finance was arranged with First Response, all was good and i was really pleased with my new Omega.
then in feb this year i discovered i was pregnant with my third child, and my husband already has a son with his x partner so with this we realised in a few months our car would need replacing for a 6/7 seater,
so i thought i would get the finance agreement out and check what was left outstanding on the car and when we could possibly hand it back or exchange for something more suitable,
this is where the trouble began! :(
on close inspection of my HP agreement under "Discription of goods" i noticed that the cars registration was wrong, then as i carried on reading it was also the wrong colour,
i got my log book out and checked the chassis/ vin numbers and did a quick check on the DVLA website and to my dismay it i had signed for a different car,
i rang consumer direct they put me in touch with trading standards who said it would be classed as an improperly executed agreement and could only be enforced by a court,
so i contacted the dealership who promptly washed there hands of the situation and said its down to the finance company now
so i contacted First Response and explained whats happened , and they have passed me from pillar to post i have told them i would like to hand the car back, and end the contract with them, i have stopped making payments (as this is the only way i seem to be able to speak to someone) they have sent me defaults saying they will collect the car but the car they want to collect i have never laid eyes on!?
so upon them saying it was all the DVLAs fault and there was an admin error by the DVLA and i should send my log book off and tell the DVLA they have an interest in the car i have got,
to me this seemed sneaky and i told them i would do no such thing, so instead i did 2 HPI checks one on the car i have got and one on the car in the agreement, the car i have came back clean as a whistle no outstanding finance nothing (no wonder there keen to get me to contact the DVLA) but the car in the agreement came flagged up with my finance agreement all over it
but the shocking thing is the keeper of this car has had it since 2004 and is probably unaware that it has got any finance stamped all over it, so i contacted trading standards again and they were shocked that First Response havent taken the wrongful finance off the car straight away as they have known about this for at least 2months now,
and she said if the people tried to sell there car and couldnt due to having my HP there they could sue the finance company,
so in the light of this i had a call from the finance company wanting payment i told them until the matter was resolved there would be no payment, i made the rep aware of what trading standards have told me and she took a few details said she would speak to a manager and get back to me
this was over a week ago now, im getting mighty fed up with the situation now like im banging my head against a brick wall, my babys due in 5wks and really need to get this sorted asap,
so anyone who has any suggestions or advice would be greatly appriciaced sorry for the long post,
