Terms of Service

General:

The Community and Forums Area ("CFA") is currently provided as a free service to any user who agrees to abide by the terms and conditions of these terms of service. Reading a message posted to the CFA, and posting a message to the CFA, will constitute acceptance of the terms and conditions of this agreement.  If you do not agree to be bound by these terms, please do not read or post messages.

moneysupermarket.com reserves the right to alter these Terms of Service at any time without notice to you. Please check the Terms of Service periodically, to see whether a change has been effected. If you do not agree with any such changes, please discontinue further use of the CFA.  Your continued use of the CFA will signify your acceptance of any changes made to the Terms of Service set out here.

moneysupermarket.com may modify, or discontinue, the CFA with, or without, notice to you, and without liability to you, or to any third party.

moneysupermarket.com intends the CFA for use by you in the United Kingdom only. We make no warranty or representation that the CFA (or any element of it) is appropriate, or available, for use in locations outside the United Kingdom. Accessing the CFA from territories where your access to it is prohibited, or where any such service is considered illegal, or unlawful, is not permitted under these Terms of Service. If you choose to access the CFA from locations outside the United Kingdom, you do so on your own initiative, and you are responsible for compliance with all applicable local laws.

Registration:

Although portions of the CFA may be viewed by anyone who visits them, you will need to register as a member in order to post on the message boards.

When you register with us, you are stating that you are over 18 years of age.  We do not allow persons we know to be under 18 years of age to register with the moneysupermarket.com CFA.

You agree that any information you provide to us about yourself upon registration, or at any other time, will be true, accurate, and complete, and that you will ensure that this information is kept accurate and up-to-date at all times.  moneysupermarket.com reserves the right to terminate your membership, and access to any specific content, if it is learned that you have provided us with false, or misleading, registration information.

When you register to use the CFA, you will be asked to create a password. You must keep this password confidential, and must not disclose it to, or share it with, anyone. You will be responsible for all activities that occur under your password. If you know or suspect that someone else knows your password, you agree to notify us immediately at community@moneysupermarket.com. 

You will also be required to activate your communities and forums account. An email will be dispatched to the e-mail address you supply with instructions on how to do this.

Message Rules:

You are entirely liable for all activities conducted by you, or by others authorised by you, or otherwise acting on your behalf.  You agree not to do any of the following actions whilst using the CFA:-

• To harass, threaten, embarrass, or cause distress, or discomfort, to another participant, user, or other individual or entity;
• To transmit or publish via the CFA any information or other data or materials ("Content") that can be considered to be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or racially, ethnically or otherwise objectionable;
• To impersonate any other person or entity, whether actual or fictitious, in the CFA, or to create a member name intended to mimic a moneysupermarket.com member of staff or community moderator;
• To disrupt the normal flow of dialogue in the CFA, or to act in a manner that adversely affects other participants;
• To post or transmit any unsolicited advertising, promotional materials, or any other forms of solicitation in the CFA, except in any areas that may be designated for such a purpose; and
• To intentionally, or unintentionally, violate any applicable local, regional, national, or international law, including, but not limited to, any regulations having the force of law, whilst using or accessing the CFA, or in connection with your use of the CFA in any manner.

Any posting which violates these community terms of service will be removed and moneysupermarket.com reserves the right to close the accounts of any persistent violators of these terms of service. moneysupermarket.com will edit or remove any posting which contains any phone number or email address.

You may not post links to alternative community groups, unless it is with the specific permission of moneysupermarket.com.

Our members must also respect the character, quality and atmosphere of the community.  Breaking these terms and conditions, which includes failing to respect the character, quality and atmosphere of the community, and which also includes making postings which demand a disproportionate amount of time and/or moderation by the Community Team, may result in your user account being banned. The length of such a ban will be at the discretion of our community team, and can be permanent. Attempts to obviate such a ban may result in our contacting your Internet Service Provider, or your employer.

moneysupermarket.com may, at any time, and without prior or post warning, close and/or remove discussions on message boards as it feels appropriate. No discussion will be entered into.

Intellectual Property:

You agree that you will not upload, or transmit, to the CFA any content that that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party. By submitting content to the CFA, you automatically grant - or warrant that the owner of such content has expressly granted - moneysupermarket.com the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content (in whole or in part) worldwide and/or to incorporate it in any other works in any form, media or technology now known, or later developed, for the full term of any Rights that may exist in such content.

You may view, print, download, or temporarily store extracts from the CFA for your personal, non-commercial reference, without alteration, addition or deletion. You may not otherwise copy, reproduce, retransmit, distribute, publish, commercially exploit, or otherwise transfer any CFA material or content. You acknowledge that you will not acquire any Rights by downloading or otherwise using any CFA content or materials.

Content:

You, and any others authorised by you, or otherwise acting on your behalf, must evaluate, and bear the risk associated with, the accuracy, completeness or usefulness of any content.  moneysupermarket.com shall not be responsible for any content. moneysupermarket.com may display, modify, transmit, distribute, or delete any content which you upload or transmit to the CFA without needing further permission from you. moneysupermarket.com does not guarantee the publication of any content and does not pre-screen or monitor content in the CFA as a matter of policy, but may, in its sole discretion, do so.

moneysupermarket.com shall have the right, but not the responsibility, to remove content which is deemed in moneysupermarket.com's sole discretion, harmful, offensive, or otherwise in violation of these terms, or any other rules moneysupermarket.com may have in place at the time. moneysupermarket.com may elect at its sole discretion, to monitor some, all, or no parts of the CFA, for adherence to this agreement, or to moneysupermarket.com rules. The views expressed in the CFA are personal to the member, and are in no way representative of the views of moneysupermarket.com, nor are to be taken as endorsed by moneysupermarket.com in any way.

Withdrawal of Account:

moneysupermarket.com reserves the right to prohibit those who breach these Terms of Service, and to terminate any accounts the user might have. If your account has been withdrawn as a result of your breach of these Terms of Service, you may not open another account with moneysupermarket.com, and we reserve the right to similarly terminate any such further account.

Contacting You:

moneysupermarket.com may contact you by email to advise you of any edits to your posts, or if your account has been suspended or closed.

Disclaimer of Warranties:

You expressly agree that use of the CFA is at your own risk. moneysupermarket.com shall not be responsible to you for any content found on the CFA. moneysupermarket.com expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.  moneysupermarket.com makes no warranty that the CFA will meet your requirements, or that the CFA will be uninterrupted, timely, secure, or error-free; nor does moneysupermarket.com make any warranty as to the results that may be obtained from the use of the CFA, or as to the accuracy or reliability of any information obtained through the CFA. No advice or information, whether oral or written, obtained by you from the CFA shall create any warranty not expressly made herein. You understand, and agree, that any content downloaded, or otherwise obtained through the use of the CFA, is so obtained at your own discretion and risk, and that you will be solely responsible for any damages to your computer system, or loss of data, that results from the download of such content.

Limitation of Liability:

To the full extent permissible under the applicable law, moneysupermarket.com shall not be liable for any direct, indirect, incidental, special, consequential, or other damages resulting from the use of, or inability to use, the CFA; or for the cost of procurement of substitute goods and services; or resulting from any goods or services purchased, or obtained, or messages received, or transactions entered into through the CFA; or resulting from unauthorised access to, or alteration of, profits, use, data, or other intangible properties; whether based on breach of contract, or warranty, tort (including negligence but not where resulting in death or injury), product liability, or otherwise, even if moneysupermarket.com  has been advised of the possibility of such damages.

Indemnification:

You agree to indemnify and hold moneysupermarket.com, and its subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your use of the CFA, the violation of these Terms of Service by you, or the infringement by you (or by any other user of your account) of any intellectual property, or other, right of any other person, or entity.

Miscellaneous:

This agreement shall be governed by, and construed in accordance with, English Law, excluding any conflict of law provisions, and you agree to submit to the exclusive jurisdiction of the English Courts for any cause of action arising out of these Terms of Service, and any claims or allegations arising out of or connected with any message posted or read on the CFA. In the event that any portion of these Terms of Service is deemed by a court to be invalid, the remaining provisions shall remain in full force and effect.

Any failure or delay by us to enforce strict performance by you of any of the Terms of Service, or to exercise any right under the Terms of Service, will not be construed as a waiver to any extent of our rights,

moneysupermarket.com may assign its rights and obligations under these terms of Service, and, upon such assignment, shall be relieved of any further obligation under these Terms of Service.
