Lynne,
If my experience with Yes Loans is anything to go by you could be in for a long haul in order to get you money back. I found there was little point in calling their "Customer Services" number as all that happens is that you sit listening to how, "your call is important" and that, "all our agents are busy right now" for up to 20 minutes at premium rate prices. If you do manage to talk to someone they will tell you that you need to write to them and ask for you money back.
If you look up my "bio" there is a contact email address for me on it. Drop me a line and I'll send you the email of YL's general manager (can't post email addresses directly on this forum), so you can email him. You may be lucky as you specifically told the agent not to take the money until Feb 29th...
If however, he doesn't reply---
Write to them and ask for it back - use their Cwmbran address and make sure that you send the letter recorded delivery or else they WILL claim that it was never received. When the first letter is ignored, as it usually is, send a second letter (recorded delivery) giving them a specific date by which to return you money and stating that "Time is of the essence". Further, state that if you do not receive the refund by the stated date that you will commence action against them through the County Court Small Claims track without further notification.
If they don't respond, and they probably won't as I'm sure they hear that threat at least 50 times a week, then you should be prepared to carry out the threat of legal action.
Raising a Small Claim is VERY EASY and can be done on line via http://www.moneyclaim.gov.uk full details are also available on http://www.hmcs.gov.uk
It costs £25 to start the action. If it gets to this stage you should consider claiming for the Bank Overdraft charges that their action caused.
I did all this on behalf of a family member. Yes Loans caved in and refunded the money and court costs before the case was heard.
Remember, it's YOUR money, not theirs. Do all you can to get it back. Good Luck
Yorkshire-Lad.
