    Price drop after deposit paid

    Hello all, a new poster here --


    I've found a car offered for sale by an official, large Mazda dealer, signed the relevant documents 10 days ago, paid a £500 deposit and am due to pick up the car next Saturday (the 16th Feb). However, the list price advertised on their website for the exact car (photos and registration plate) that I am due to pick up has been dropped by £362. What I'd like to know is am I legally obliged to pay the price I signed for, or is there a way I should be able to pay the price currently advertised on the day I pay the rest of the value of the car?

    Hi --- I'm afraid that you will be obliged to carry out the deal at the contracted price agreed 10 days ago, unless out of goodwill they will agree to let you have the reduction, ask them they can only say Yes or No.

    On another note... if they had applied an increase in the price, you would still be only legally obliged to pay the lower contracted price as originally agreed 10 days ago. !!

    Surely after you paid the deposit the car should be marked "sold" or was it a press ad they couldn't stop?

    It's a web ad and very easy to edit, in fact it looks like it's done by hand it's so simplistic.

    CK, I thin kyou're probably right, and that would make sense... I just feel slightly put out that a car that has been virtually sold is still advertised and at a lower price, that's like a slap in the face isn't it? And if another customer bought it outright at the lower price, would I be entitled to a refund on my deposit?.. Hmm.

    Hi Cirieno --- I agree it's not very nice to see a car you've agreed to buy still being advertised at all.... and even worse to see the price has been lowered, which is why you must try to get their agreement to lower the price out of goodwill.

    Had they sold that car onto anyone other than yourself, then they would be in breach of their contract with you ... accordingly this would leave them open to legal action brought by yourself for them breaching a legal contract, which could include compensation and the return of deposits already paid by you.
