Car-Jacked for my 08 Golf.. now jacked by insurance...
Hi, I was recently car-jacked by 3 men who beat me up and took my car, along with my phone and wallet, with all my bank cards etc.. I have claimed on the insurance - but what is the reailty they will get me a new car? My vehicle only had 500 miles on the clock. Thanks in adv for your comments. Admiral Insured.

They should either offer you the value of your old car or, if it is recovered, the cost of repairig it. If you are not happy with the first offer, you should say so. Remember though that the more you claim the more your next premiums will go up. Depending on the nature of your ijuries, you may be able to claim through the criminal injuries compensation scheme. The police should ensure that you get the details for this.

As a brand new car, and a total loss, you will get another brand new one subject to the police investigation (if any) being satisfied.

A few years ago I gave a lift to a Russian teacher in my 12 year old (at the time) Vauxhall Cavalier. I was speachless when she said that it was just like new. The point is that, whatever a car looks like, it is not new unless it comes out of the showroom with a couple of miles on the clock, registration papers dated now and with colour, trim, accessories, etc. as chosen. There is a difference in value between a brand new car and a car with 500 miles on the clock. Your insurance company would be quite entitled, if they wished, to give you the value of the latter. While you can certainly argue whether their interpretation of that value is accurate or not and while they may even decide to give you a brand new, ex-showroom car, you cannot reasonably insist on it.

I'd urge you to re-read your insurance documentation which will read: NEW VEHICLE REPLACEMENT: If your vehicle is less than 12 months old from the date of first registration and it is: damaged so that the cost of repair is more than 60% of the maker's current list price, or it is stolen and not recovered This benefit only applies if a new vehicle of the same make, model and specification is available straight away in the UK. There is absolutely no reason to 'argue whether their interpretation of the value is accurate' as, in the OP's case, is irrelevant where the vehicle is not recovered and is covered under his policy automatically!

I cannot find the wording on my policy details (it may well be there though) and googling for the first phrase turns up a grand total of one result. Such wording is certainly not universal, even if the cover may be. OP needs to check the relevant policy.

Yes, the OP needs to check the relevant policy for any exclusions under this benefit and to also contact the insurer to confirm that this is part of his/her policy, especially where the Admiral policy book doesn't contain this information. The wording may differ slightly. Instead of starting with an "If", it may start "Where", or "New" (!!) but the core cover IS universal throughout ALL GOOD INSURANCE COMPANIES! Even Swiftcover have this as part of their policy wording... and that says it all!! Although, looking into it, Swiftcover amend the damage to say 70% to lessen the chance of them having to settle in this way! Hardly suprising there though! Snippet from Swiftcover: New car cover If Your Car is less than one year old and You have been the first and only registered keeper and legal owner, We will replace it with a new one of the same make and model if it has suffered damage covered by this section and the cost of repairing it will be more than 70% of the manufacturer’s last UK list price (including taxes). Snippet from Groupama: New car replacement if the car is under 12 months old, and the policyholder is the first or second registered keeper (where the first owner is a main dealer of the car manufacturer). Snippet from Norwich Union: If your vehicle is less than 12 months old from purchase as new when you have an accident - or it's stolen and not recovered - a Norwich Union car insurance policy will give you a new car of the same make and specification (if one is available in the UK). - Provided the cost of your car insurance claim is more than 60% of the UK list price (including car tax and VAT, when you bought the car)

Well, I'm currently in talks with Admiral at the mo.... and they are "investigating".. although the police failed to get anything... i managed to obtain CCTV of the attack and robbery. Rather violent when i look back now.... but the police didnt even bother going to check for CCTV... yet i managed to get it luckily as the people with CCTV cams told me it records over after 72 hrs. I gave a copy of the robbery to Admiral and the police.... lets see what happens now... thanks for the replies guys. much apprciated. by the way ..... its a black metallic golf..... with fogs.. with some scuff marks on the number plate surround at the front-left. VIN plates have probably been changed now. If Anyone comes across it, ur more than welcome to keep it (crash and die in it).

I spoke with admiral who have advised they cannot buy me a new car however emphasised the fact that the policy staes they will only issue a payout of the market value of the car. now, i cannot go out and buy a new car with what they are going to give me, so i've lost out... they have not goiven me an offer yet... what should i do?

Be prepared for their offer with a counter offer. Obtain written quotes to purchase an equivalent car (head to your local dealer and ask about ex-demonstrators or pre registered cars). Try to pursue the criminal injuries compensation - this may help with getting you back in the realms of new car prices. Consider GAP insurance next time. (I know this is like making a bolt for the door after the horse has galloped away but imagine how much out of pocket you'd be if this happened 2 years down the line...)

Ah, yes. I investigated this myself and found that Admiral are one of only a few to exclude this. When insuring a brand new vehicle, it is always worth ensuring full adequate cover. The likes of Admiral and few other 'cheapies' are really not advised for this exact reason. Unfortunately, and probably because you have exceeded 250 miles on the clock, the vehicle value will have depreciated a little more than if it hadn't have exceeded this amount. As per other's advice, it may be worth looking to GAP insurance. It's a little saving grace that the car was bought recently and is the newest reg in the current market! Avoid Admiral, Swift (see their 70% damage policy) and Norwich Union (if you can help it - they have a little more stringent policy for replacement vehicle).

It's been 2 weeks now since the inicdent going on 3. The insurence company Admiral have not gotten back to me yet..? The investigator has been, taken the log books keys etc.. and a statement.. so what is the hold up with the payout? I have had to hire a vehicle myself - at a cost of £209 a week.. and its making me bankrupt! What is the time allowed for the insurance to old back before they HAVE to make a payout?

Called Admiral this morning, and behold, they have told me that they are still awaiting for the Investigators report? The investigator came round on the 18th of April 2008, and they are telling me that he has to type up a report and then send it to them... meanwhile im getting shafted on hire cars. Is there any particular time or anything that states the insurance must payout by? really stuck right now..

Admiral have come back to me with a payout quote... wait for it... ..... £15000 minus the excess of £250.... but im still waiting on VW to provide me with a cost for the purchase of the same vehicle with 500 miles on the clock. I told admiral I will get back as soon as VW can provide me in writing how much it will cost me to get the car on the road with the same spec as the one that was stolen.
