    Flooding

    We were affected by the flooding in June, then again in July. In between, we advised the Environment Agency and the local Highways department of the two problems which were causing the floods- basically blocked culverts downstream, causing the stream level to rise, and open gullies which let the stream water come up the drains onto the road! However, because another part of this road 'is prone to flooding,' nothing was done to rectify either.

    We have now had to submit a claim to the insurers for damage to the gable wall, which has been sat in water, and also had the lime mortar, stone and brickwork pulled away from the house. The damage to the garden, fences etc are not covered. Can we claim from the EA/ Highways for the uninsured damage? They have all agreed to repair their faults/ lack of maintenance.

    Will their unrectified problem and our claim make it difficult for us to insure our property next year?

    A history of flooding will always make it more difficult to insure a property, regardless of the reason for the flood.

    Yes you could claim off the liable parties, but bear in mind that you will need to do this privately and the onus will be on you to proove they were negligent (so you need to be able to proove they ignored your report)

    The question do you live within 400m of a river is misleading. I live with 400m outside the actual floodplain some 30ft above the normal river levels. If we were to flood i would expect to see Noah. there should be a supplementary question such as How many feet are you above normal revier levels
