    Hi All



    I'm going to start a petition on the Number 10 e-petitions system, not sure what wording to use, thought I would consult others on what to use.

     
    I think it should go along the lines that the mobile phone operators should be held accountable for the cash back deals and honour the cash back offered by their agents.

     
    However, there is the issue reported on some forums that the agents were claiming that people had forgot to put a page of their bill in when submitting cash back claims hence invalidating cash back. So should some blame pass to them?
    Or were they backed into a position to find ways not to pay out by some sort of commission squeeze from the operators?

     

    I haven't read too much into the fiasco or watched the watchdog programme. Perhaps i'll do some research first!

    The business has now gone bust and was apparently discussed in parliament as the administrators have indicated cool new mobile only provided the handset..............the airtime contract is still held between the end user and the network provider.  Therefore no rebates.................full undiscounted rate still to be paid etc.

    Vodaphone have advised they will be in touch to advise what is going to happen.  All in all it was always to good to be true although we have had 2 years of free mobile calls so if we end up having to pay in the third year can't complain to much................

     

    It was a bit annoying though that the announcement was via an email from an email address you wouldn't directly associate with mobile affil.  Here was the contents of that email that we received in our spam mailbox.

    Mobile Affiliates Limited t/a Coolnewmobile and Phones2yourdoor - In
    Administration

    Birmingham County Court No. 5302 of 2007

    Mobile Media Systems Limited t/a Phoneboxdirect - In Administration

    Birmingham County Court No. 5303 of 2007

    I would advise you that I was appointed Administrator of the above
    companies jointly with my partner Alistair Steven Wood by the
    directors on 14 November 2007. I am authorised to act as an
    Insolvency Practitioner by the Department of Trade & Industry and my
    partner is authorised by the Institute of Chartered Accountants in
    England & Wales.

    The companies have ceased trading and their offices are now closed.

    The statutory purpose of an Administration consists of three
    objectives:

    · rescuing the company as a going concern;

    · achieving a better result for the company’s creditors as a
    whole than would be likely if the company were wound-up (without
    first being in Administration);

    · realising property in order to make a distribution to one or more
    secured or preferential creditors;

    Within eight weeks (or such longer period as the court may allow) of
    the date of the Administration Order, I am required to prepare
    proposals which I will publish on the Joint Administrators’ website
    www.phoneboxdirectinformation.com.

    As Joint Administrator I am not in a position to pay any amounts due
    by the company in respect of contractual obligations entered prior to
    the date of the Administration Order.

    Following my appointment customers have requested a response to two
    specific questions namely:

    · Recovery of cash backs due from the company.

    · Contractual obligations with the network provider.

    As far as the cash back is concerned my current estimate is that
    there are over 30,000 customers who may be eligible to make cash back
    claims. My current estimate of this liability is between £4-10
    million. The companies’ assets are less than £250,000. It follows
    therefore, that after the payment of the expenses of the
    administration and the preferential creditors (wages and holiday pay
    owed to the employees) it is unlikely that there will be funds
    available for unsecured creditors.

    Turning to the second matter, I am unable to comment on a
    customer’s contractual position with their network provider,
    customers must therefore, either speak to the network provider
    directly, take legal advice or contact their local Citizens Advice
    Bureau or Trading Standards Office. The network providers and/or
    their agents should not be referring you back to me.

    Please refer to the Joint Administrators’ website
    www.phoneboxdirectinformation.com which will be posted with further
    updates for the benefit of customers and creditors. This website has
    been set-up to enable you to record your claim against the relevant
    company. Please do not write to my office to submit your claim as
    written communications will not be acknowledged.

    Have you lost your cashback because of the default or insolvency of a mobile agent or distributor? You may be able to get your cashback after all. There is no cost intitally and no payment to us. We are just consumers like you. We are not planning to make any profit out of you or to take any money from you. This is just a group of consumers getting together to get their cashback.

    I found that the site previously being run by Mobile Affiliates Limited is now being run by the administrators. It has lots of useful information about putting in a claim to get compensation. It can be found at cool new mobile or at http://www.phoneboxdirectinformation.com

    This also explains the administration process of the company.

    Hi, yes, unfortunately we did lose out on our deal with CNM (Mobile Affiliates) that went into administration last year in Nov and we have since been contacted by the lawyers but so far nothing seem to be done by the authority to help regain our lost monies. We can only be but hopeful that something will crop up in the future. Have you been able to do anything in regaining the lost monies from insolvent companies???

    On consolation, we are pleased that CNM has gone into administration and are not continuing to cheat innocents customers like us however there are many bogus traders like them out there still operating.

    We now take our cashback deals with only reliable companies run and managed by the big boys themselves and so far our other cashback contracts has been good.

    Let us know if there are other things we can do with regrds to CNM.

    Hi,

    I was wondering if someone could help me re Mobile Affiliates. I got out a contract with them whereby I would send off my 1st, sixth, eighth, tenth and twelth mobile phone bill and after sending the twelth I would get £420 cashback. I sent all my bills to them religiously but I have just received the twelth one back from Royal Mail saying that Mobile Affiliates have 'gone away'. Obviously I am distraught as this is a very large amount of money and I took great care to send all the correct phone bills, at the correct times.

    However, I can't seem to find any contact details for them and upon Googling them I can across this forum- I am clearly not the first to be conned. Does anyone have their contact details or any advice they could give about what to do next? I would be very grateful for any help at all.
