    Mis-sold an upgrade by Phones4U

    My daughter (aged 18) was cold called by Phones4u Direct and persuaded to agree to an upgrade on to a £45 pm tariff with vodaphone. She was told the phone was not available yet anywhere else (it is) and heavily persuaded that this was the best deal for her to avoid paying additional charges by going over her limit. At no time was she asked what her usage is (which averages 450 mins and 400 texts over the last few months). Clearly there are much cheaper tariffs available.

    Obviously she shouldn't have agreed, but does anyone think this is a case of mis-selling? She called Phones for you 2 weeks after the initial call, and was told there is no cooling off period and nothing they can do to cancel or change the contract.

    I am helping her draft a letter, and would like advice about what to put and how best to challenge this.

    *Phones 4u offers you a period of 7 working days after the date of delivery (not including the day of delivery) to inform us of your intention to return an item, and a further 7 days to return the purchase to us. Your purchased item must be in perfect condition, in the original packaging and we will refund your purchase. Just keep your receipt and all you will be charged for is the line rental used and any calls made (if applicable).

    You will need to obtain returns authorisation from the Phones 4u Direct Support. The purchased item must reach our warehouse within 14 days of connection otherwise the return will not be processed, and the item will be returned to yourself.

    *Please note, if you have purchased a pre-pay handset with airtime included, you will only be entitled to a refund for the cost of the pre-pay handset and not the sim card and the associated mobile phone airtime credit. When returning your handset you should keep your sim card as this will contain the airtime you have purchased.
