Yes Loans £49.50 Set Up Fee
Help pleaseeee, I stupidly paid the £49.50 charge as i was told i would get a loan with days blah blah.. its been 2 month and i dont want the loan I just want my money back.. They are no help when you phone them and they just put you on hold for agessssssss which costs a bomb.. Someone please help ? Thanks Rach =)

Conmankiller im sure everyone appreciates all the hard work you put into the forum her but come on 52,983 post is that normal ?? or do you work for money supermarket ? Im certainly starting to question your motives and stabiity. You seem to have to post your opinions in every thread on the forum. If i had a penny for every time you postd on her id have £530. Please for your own sake take a day off Martin Lewis has already cornered the consumer champion market theres not enough room for both of you.

Hi Rach, sorry to read about your problems.I'm currently proceeding against this company in Northamptonshire County Court under the Small Claims procedure for the very same reason - I wrote on numerous occasions and - like you - was ignored completely. Although my last letter before proceedings offered a final chance for them to settle simply by paying up the £49.50, it's interesting that the company sent me a cheque for £74.50 (the amount of the fee, plus the summons issue fee of £25), as soon as they received the summons! They also included "all the paperwork" for signing and sending back to the Court to halt the proceedings. However, I had also added a further £25.50 to represent my additional expenditure in corresponding with the company, so the proceedings are still running, and at the present time they have not sent me details of their Defence. If they do not do so by 13 May, I will apply to the Court for judgement by default, which means they will have to pay the extra expenses plus the costs of a Warrant of Execution if I have to send the Court Bailiffs to their premises to collect it. You should send the following letter to their Registered Office (NOT their usual office address in Cwmbran) as follows: To: Yes Loans Limited, T/A "Yes Loans", Cradoc House, Heol-Y-Llyfrau, Aberkenfig, Bridgend CF329PL. Dear Sir/Madam WITHOUT PREJUDICE - Letter Before Proceedings Ref: (put your customer reference here) I have still not received repayment from you of my application fee for a Yes loan that was not proceeded with, and I am now advising you that proceedings will be commenced if this is not received by (insert date 14 days after date letter will be posted). I will issue a summons against you under the Small Claims Track in Northampton County Court for the recovery of the sum owed by you of £49.50, the issue fee of £25, and my expenses necessarily incurred in unsuccessfully trying to obtain a refund (work out the cost of phone calls, letters, etc. and include this here). You can settle this matter by forwarding your cheque for £49.50 to the above address at any time up until the date of issue of the summons, following which there will be an arbitration hearing before a District Judge at my local County Court, to which the matter will be transferred should you decide to enter a Defence. If judgement is awarded against you by default, a Warrant of Execution will be applied for, so that the total sum awarded (plus the Warrant issue fee of £30) can be collected by County Court bailiffs from your Registered Office address: Yours faithfully, etc.

GraceCourt, Very good point about using Yes Loan's registered address for court proceedings rather than their regular address. They sent me their paperwork for me to sign to end MY court action too. I pointed out that there was no way on God's Green Earth that I was going to sign ANYTHING that they sent me and that as it was MY court action that I would end it, not them. Impressive letter - If this doesn't get their attention then they are less bright than even I suspect.. Good luck with this. Yorkshire Lad.

hi, i got in touch with yes loans the other week enquiring bout a loan, the man on the phone took my details etc, i told him i couldnt afford to take the £60 admin out my account just yet,, he told me if i wanted to cancel then all i had to do was phone yes loaans ( stress loans) and it would be canceled, simple as,, so few days down the line i read all the horror storys and decided to cancel this service.I NEVER SIGNED ANY FORMS THEY SENT ME. but to my horror today i checked my bank account and yes loans had taken out there 60 quid, they did this after i phoned up to cancel, the woman on the phone told me i had canceled and i wouldnt be getting any more calls texts or emails etc n that was it,,,,,,but they took am money still now today i called stress loans back and was told a load of rifraf about writing in to cancel via written letter and she sed that ya cant cancel by phone. and basicly had a go at me for getting uptight with them,,called me disrespectful lol,,,,,,,,so i seem to be in the same boat as a few on this site, i have email yorkshire lad for any helt but if any1 has any more info please let me know thank ya wayne.

I would becarefull doing it this way, fine to take action but by her accepting and cashing the cheque she agrees to settle. Well, it's getting interesting... Yes have entered a defence, much of which is complete fiction. It refers to letters sent to me, but in fact I never once received anything in writing from them, that's why (in the end) I issued proceedings! More interesting is the fact that the defence opens with a reference to the agreement being "... subject to the Defendant's Terms and Conditions" - but no copy of any were supplied (so they aren't enforceable) and the only ones referred to in the Web site sign-up process relate to the use of their Web site - not to their role as a broker in arranging to introduce potential borrowers to loan companies! So, the Allocation Questionnaire (which goes to the Court as the basis from which the arbitration hearing is arranged) will require them to produce strict proof of the Ts & Cs, and strict proof of the service of the letters referred to. They also state (surprisingly) that they take 60 days to arrange refunds (!) and the dates they use for receipt of our correspondence are months after they were posted... so a little too economical with the truth, and the District Judge will not be amused if they turn up for the arbitration with that attitude. So, I shall keep you up to date with events, and of course if we win, there will be a claim for witness expenses (they will probably rely on their written submissions and not attend themselves, it would be crazy if they did).

Grace, <> They did very much the same with me... then, about a week after the notification to contest the claim arrived, I received my "admin fee" back, closely followed by an additional cheque for the court costs. If you still have the Recorded letter slips their fictional dates for receipt of correspondence will just fall flat. How comes it takes them (usually) less than a day to take your money but they are now claiming it takes 60 days to return it?? Hardly reasonable - but then whoever said Yes Loans were reasonable. I'd be very surprised if they allow this to go to court as they must know that their "case" has more holes than a sieve and it won't need Perry Mason to pull it to bits. If they do cave in before the hearing they usually send some old rubbish letter that they want you to sign so "they can end the action". Interesting as it's not THEIR action to end. Does the "defence" paperwork they provided have any other email addresses for YL than the ones I let you have a while ago? If it does I would very much appreciate it if you would send them to me as I would like to continue helping people AND being a thorn in the side of Yes Loans. Good luck with it. <> Yorkshire Lad. <>

A word of warning if you take a company like this to court always ensure you use the paper filing system and not money claim online, if you use money claim online and they enter a defence it will cost more as you have to then file further paperwork to get it to a judge and further costs

The allocation questionnaire (the "further paperwork" to which you refer) is filed with the Court free of charge if the claim or counterclaim does not exceed £1,500.
