    Local Area Searches

    Hi

     I bought my current home last March.  I did all the right things, well the solicitor did.  All the relevant searches and so on.  Everything came back fine.

     After about 6 months, I got a letter detailing the new bus lane that is to run along the side of the boundary to my house.  After a few letters to and from the council, the council finally admited that they were wrong and that the bus lane should of shown on our searches they apologised and sent the file to their insurance company.

    I have explained to the insurance company that if I had been aware of the proposed bus lane I would not have bought the property.  I also feel that the bus lane will have an effect on the value of my home and the ability to sell it on.  They however, do not think that I will lose out financially.

    Any advice would be greatly appreciated on where to go from here.  Is it worth taking it further?

    Your solicitor did all the right things and that's his job and not yours. He's insured. Have you spoken with him? It may be that it's his liability to you and he has to go after the council. Just a thought.

    Thanks for the reply.

     Well I have spoke to the solicitor and he basically said he could not get involved incase it went to court he would be called as a witness for me.  I would need to see a solicitor who specialises in this field.  Before I went to one just wated to know whether I could be successful, as we all know solicitor fee's cost a lot.

    Your solicitor did the work and he may be called as a witness. interesting, possible but he's missed a few steps out. Four free things to do:-

    1   Phone the Law Society and explain

    2  CAB and explain and get half hour free with specialist solicitor.

    3  Go to a solicitor and ask who you should go to and get a half hour free direct with a specialist solicitor.

    4  Go to your local reference library and ask a librarian to show you the reference books which show solicitors' specialisations and I have in the back of my mind ratings but that may or may not be for barristers. Pick librarian's brain - good people.

    DON'T let anyone pass you from pillar to post. You show them you're an informed laywoman and be assertive and not aggressive and you'll get the best out of them. Remember if it doesn't sound right challenge it.
